As it turns out, a turkey sub that I bought at the end of January and paid for with a check, an $8.04 check, a check that bounced.

3 month lull, I get a letter in the mail.

A WARRANT HAS BEEN ISSUED FOR YOUR ARREST for drawing, making uttering, issuing or delivering a worthless check, contrary to section 832.05(2), F.S.

As an alternative to appearing in court or being arrested on such warrant, you may elect to complete the following steps:

1. Make restitution (pay the amount of the check plus fees) to the person or place of business to which the check was written (or their collection agency) and obtain a receipt of your payment from this business. (Copies of money order receipts are not acceptable).

2. You must appear in person and bring the receipt of payment, this notice and cash or a certified check or money order payable to Bridgeway Center, Inc., in the amount of $25.00 for diversion fee plus $30.00 service fee to the Bridgeway Center, Inc., Probation Support, 151E NE Eglin Parkway, Fort Walton Beach, Florida, 32548 (850-833-7444) or at 351 North Ferdon Boulevard, Crestview, Florida, 32536 (850-689-7843), Monday thourgh Friday, between the hours of 8:30 a. m. to 12:00 p. m. and 1:00 p. m. to 5:00 p. m., by 04/13/2007. If this date falls on a weekend or hilidat, payment will be due the next business day. It is required that proof of restitution, diversion fee and service fee be submitted on the same date.

Should you fail to call or appear by the above date, the warrant will be activated for your arrest for the above worthless check charge.

If convicted of a misdemeanor of the first degree worthless check offense, the maximum penalty of $1000.00 or one year in jail, or both; if convicted of a felony of the third degree worthless check offense, the maximum penalty is $5000.00 or five years in state prison or both.

This is the only notice you will receive before being arrested.


So, let alone this is my first notice of any sort. WTF. I'm glad that in this day and age, Publix is willing to take me to the mat over a Turkey Sub. It makes feel warm and cuddly inside.

So, first I called Publix to see how much their fee was, $25.00 apparently.

$8.04 + $25.00 + $25.00 + $30.00 = $88.04

So, I went out to the bank. Oh goodness, I guess they were out of bills that day.

And you'd not be able to get away with that in Australia, there is an actual limit to the number of coins a vendor has to accept before they can legally refuse to accept your money(its pretty high, something like $20 for 5c coins(which would be 400 tiny coins in total).

Still, in spite of your spelling, good work sticking it to the man.

who writes checks anymore anyway?

break all the rolls, put it all in big ziplock bag and pour a little mountain dew in it and let it dry over night.

I would also have considered paying it in singles with FUCK YOU written largely on both sides in sharpie on all of them.

You should really publicize this as much as possible. Most food joints bend over backwards to ensure good service and if a company is so petty as to go after a person this far for a single sub, the damage in terms of reputation might just be the kick in the pants it really needs.

So don't hold back, get a website, post those photos and the letter you got and the name of the company in big, bold letters. Who knows, you might start a craze. If they want $100 for a sub, make them earn it for a change.

I can't imagine why the company wouldn't just mail a polite letter informing you of your bounced cheque and asking for payment. Just takes like 10 minutes of an intern's time and the cost of postage.

Indeed, they should have, that's why they have a $25 service fee in place. I guess they decided that for my check, this step was superfluous and we should immediately get the state attorney's office involved.

Yeah, cause it's totally Publix's fault that he bounced a cheque, causing Publix to get hit with $55 in bank processing and service fees (which they are now trying to recover), not to mention a waste of corporate time and resources that their fee of $25 probably does not even cover.

Think about it - Publix does not know if a cheque is good or bad until after they deposit it into their account, a couple of days after which the bank's cheque processing center informs them that the cheque has bounced and that Publix is on the hook for the diversion and service fees (charged by the bank - not Publix), not to mention the waste of their time which is not just 10 minutes for an intern and postage. When all is said and done, Publix will probably lose money on the whole deal, not to mention the hassle for them. This is why businesses take a hard line against bounced cheques, not to mention the whole betrayal of trust/credit issue.

While I disagree with the initial notice being the final notice with a possible warrant issued for arrest, this is a good example of a case where the customer is not king and is the one at fault.

Think of it as an $80 lesson on how to balance a chequebook and keep a budget, and stop trying to make it look like you are a "victim of the system". All you are doing is causing someone else grief and helping to raise costs throughout the system.

Sheeesh...

I'm more than willing to pay charges on a bounced check. Pressing criminal charges over a matter of $8 is a waste though. It's wasteful to our DA office, it is wasteful to the court system. Had they notified me prior to pressing charges I would have gladly paid the $8 for the sammich and the $25 processing fee, like is normally supposed to happen.

I fucked up, my check went through before my deposit. Sure. No shit. I still don't see how this warrents wasting your tax money on litigating me over a Turkey Sub. I am at fault, and I'm willing to take my medicine, Publix overreacted.

As for this exercise, they waste my time, I waste their's. The cashier has tools on hand to count change, they do it every evening when they count their till. It's a statement more than anything. Plus this will save them a trip to the bank, if anything.

OK, so I don't know OmnipotentEntity that well, and for all I know he's probably some hobo who posts on this forum from the library computers and he went dumpster diving one day and found someone's chequebook relatively intact and decided to get a sub.

But on the *slight* chance that he's not living off social welfare he might have forgotten to deposit his paycheque at the bank on Tuesday and other unimportant things *might* occupy his mind rather than the extremely important detail of how he paid for lunch. All of a sudden BLAM he's being practically accused of fraud for not ponying up the kingly sum of $8. EIGHT FUCKING DOLLARS MAN. THAT'S LIKE A WEEK OF HIGHSCHOOL LUNCHES WE SHALL LIVE LIKE EMPERORS OF ROME

I'm with the companies on this one. For too long we've let the worthless freeloaders leech away our profit margins with bad cheques for $8 turkey subs. As a matter of fact, we're doing this OmnipennilessEntity a favor. Surely bringing this grave injustice to light will do nothing to his credit rating and will not crop up whenever he asks a bank for a loan. And in the end we shall show the scum of the world how we do BUSINESS. It is only reasonable to hold the people who deal with us to the same flawless and impeccable standards that companies have.

Generally the person at the Customer Service Counter is ops sup. So it's not just some wage slave.
