This protects citizens from the federal government only. However:

This has been interpreted by the supreme court (I don't remember the exact case) to mean that the First amendment restrictions of the Federal Gov't apply to state governments as well.

Phelps does not make demands or threats, nor are his actions continued against any particular person, so it would be a stretch to apply this definition to Phelps. Unfortunately it seems that Phelps has the constitution on his side. There will a legal battle over this and probably very soon.

So, slippery slope? Oh yeah. Is this guy nuts? Definately. Is he protected by the constitution? Same as us.

As far as I can tell the law does seem to be on his side, as far as protests. His message is incorrect, but the fact that he can say it anyway is one that our country was technically founded upon. Punishment by a distant government and denial of basic rights guaranteed by the government are what started the revolution in the first place (taxation without representation, the latter of which was guaranteed to all citizens).

I'm sad for what's about to happen because I virtually guarantee that it will lead to a limiting of rights very quickly. It's pretty much been our law makers' track record. It's one reason we can sue so easily and get away with it now... fewer personal liberties for the sake of not offending others.

The fact that someone brought the law up as a bill is a general indicator that it will be brought up again and again and again until at some point it'll go through. Pandora's box and all that. :911:

I just hope the Phelpians get arrested on Saturday and thrown into a cell with one of those evil sodomites named Bubba.

Phelpian lawyers say the law will not even apply because of their proxemity to the church.
We'll be across the street or down the street. We'll keep a respectful distance and put our signs in the air.
