Peaceful assembly is protected by the constitution. To create a law inconsistant with that shouldn't ever fly.

The question comes in as to whether or not Phelps' protests are peaceful. If they are there purely for the purpose to incite violence, or if they cause violence themselves, they are no longer constitutionally protected.


A lawsuit like this doesn't hold much water, as they typically just stand there and yell obscenities. I don't support any restriction on where people can peacefully assemble.

With all that being said, I think he's a total asshole. The way people have taken care of business back home in Texas when he shows up is to get groups larger than the WBC to stand as picket runners to keep them a certain distance out.

I think we should get a shitload of homosexuals to get together outside of WBC in Topeka daily. Get enough of them constantly pestering Phelps, and he'll do something stupid to violate his constitutional rights and then we can lock him up.

I think it would really depend on what judge they get, this case could swing either way. I know I find it hard to believe that these people don't go out with the intention of causing some sort of distress and malcontent among the events they picket.

I suppose it'd be up to the judge, and his/her interpretation of harassment.

The Phelps clan is absolutely abominable, of course, but restricting free speech is a dangerous fucking precedent, which should be avoided at all costs.

When free speech hedges into harassment, it's abuse of that right. It's great that we can say what we want and all, but when it's specifically said to hurt or harass someone, why is that still considered alright? We don't tolerate people who harass people in a sexual or racist fashion, why should be be lenient when people harass people in a religious way, to the point that the Phelps take it to?

The freedom of speech, just like any other right, requires responsibility. And using (re:abusing) that right to harass those who don't agree with your beliefs at something as solemn and emotional as a funeral is not responsible.

And this may be just me, but the fact that they send their family members through law school to defend their deplorable asses just testifies to the fact that they know they're walking a razor thin line.

Yes, we do. If you want to stand on a street corner and shout abuses at anyone and everyone, you have every right to do so.
